Barefoot Guides' Outfitter / Guide Policy

This policy outlines the terms of collaboration and mutual responsibilities between Team Barefoot, Inc., DBA Barefoot Guides (herein referred to as “Outfitter”), and the fly fishing guide (herein referred to as “Guide”) to ensure a professional, respectful, and mutually beneficial relationship.
  1. Employment Status: – Guide’s Role: The Guide is an independent contractor and not an employee of the Outfitter. They retain the freedom to conduct their services as they see fit, within the bounds of this agreement, but will attempt to be available by voice or text within 3 hours of Outfitter reach-out.
  1. Compensation and Fees: – Payment Structure: The Outfitter agrees to compensate the Guide at a 80% rate per trip. – Timely Payment: Compensation will be provided to the Guide within a specified time frame following the completion of each trip.
  1. Bookings and Scheduling: – Allocation of Trips: The Outfitter will fairly distribute trip bookings among available Guides, considering their expertise, client preference, and availability. – Cancellation Policy: In case of a client cancellation, the Guide will be compensated 90% to compensate for their reserved time.
  1. Equipment and Supplies: – Provision of Equipment: The Outfitter will provide necessary communal equipment. The Guide is responsible for their personal gear and ensuring it meets safety and quality standards. – Maintenance and Care: Both parties are responsible for the proper care and maintenance of equipment in their possession.
  1. Safety and Compliance: – Legal Compliance: Both parties agree to adhere to all applicable laws, regulations, and conservation practices. – Safety Standards: The Guide is responsible for maintaining the highest safety standards and providing safety briefings to clients.
  1. Training and Development: – Continued Education: The Outfitter may provide opportunities for professional development, and the Guide is encouraged to continually enhance their skills and knowledge. – Guide is required to carry a first aid kit on their person when guiding. – Guide is required to hold an active First Aid and CPR certifications.
  1. Client Interaction: – Professional Conduct: The Guide will maintain a high level of professionalism in all interactions with clients. – Feedback and Resolution: Both parties agree to communicate openly about client feedback and resolve any issues collaboratively.
  1. Environmental Stewardship: – Conservation Practices: Both parties commit to promoting and practicing ethical fishing and conservation of natural resources. – Education of Clients: The Guide is expected to educate clients on sustainable fishing practices and respect for the environment.
  1. Termination of Agreement: – Notice Period: Either party may terminate this agreement with a written notice, subject to a mutually agreed-upon notice period. – Breach of Agreement: In cases of breach of agreement terms, the aggrieved party reserves the right to terminate the agreement immediately.
  1. Dispute Resolution: – Conflict Management: Any disputes arising from this agreement will first be attempted to be resolved through mediation before any legal action is taken.
