Welcome to Barefoot Guides. These Terms and Conditions (“Terms”) govern your use of the website located at fly-fishing.guide (the “Site”) and your booking and participation in guided fly fishing trips, lessons, and related services (the “Services”) offered by Team Barefoot, Inc., doing business as Barefoot Guides (“Barefoot Guides,” “we,” “us,” or “our”). By using the Site or booking our Services, you agree to these Terms. If you do not agree, please do not use the Site or book with us.

1. Our Services

Barefoot Guides provides guided wade fishing trips, fly fishing instruction, and related outdoor experiences in the North Carolina High Country. Descriptions of trips, rates, and schedules on the Site are provided for general information and may change. Current rates and policies, including our deposit, cancellation, and weather policies, are set out on our Fishing Policies page, which is incorporated into these Terms.

2. Bookings and Payment

A reservation is confirmed upon receipt of the required deposit. Deposits, refunds, cancellations, and weather-related changes are governed by our Fishing Policies. The balance for a trip is due on the day of the trip unless otherwise agreed in writing.

3. Assumption of Risk

Fly fishing is an outdoor activity conducted in and around moving water and uneven terrain. It carries inherent risks, including but not limited to slips and falls, immersion, changing weather and water conditions, hook injuries, and remote locations with limited access to medical care. By booking a trip, you acknowledge and voluntarily accept these inherent risks for yourself and any minors in your care.

Participants may be required to sign a separate liability waiver and release before a trip begins. You agree to follow your guide’s safety instructions at all times, to disclose any medical conditions that could affect your safety on the water, and to use provided safety equipment as directed. Guides may modify, relocate, shorten, or end a trip where conditions or participant conduct create a safety concern.

4. Licenses and Legal Compliance

Participants are responsible for holding a valid North Carolina fishing license appropriate to the waters fished, unless otherwise stated in writing for a specific program. All participants must comply with applicable North Carolina Wildlife Resources Commission regulations. We practice catch-and-release fishing and expect participants to honor that practice on our trips.

5. Website Use and Intellectual Property

Unless otherwise stated, Team Barefoot, Inc. and/or its licensors own the intellectual property rights in the Site and its content. You may view, download, and print pages from the Site for your own personal, non-commercial use. You may not republish, sell, rent, sub-license, reproduce, or redistribute Site content without our prior written consent, and you may not use the Site in any way that is unlawful or harms the Site or its availability.

6. User Content

If you submit reviews, comments, photos, or other content to the Site or authorize us to share them, you grant Team Barefoot, Inc. a non-exclusive, royalty-free license to use, reproduce, and display that content in connection with our business. You represent that you have the right to submit such content and that it does not infringe any third party’s rights or contain unlawful material. We may remove user content at our discretion.

7. Third-Party Links

The Site may link to third-party websites (for example, license vendors or partner organizations). We do not control and are not responsible for the content or practices of third-party sites, and a link does not imply our endorsement.

8. Disclaimer

The Site and its content are provided “as is” and “as available.” While we work to keep information current, we do not warrant that the Site’s content — including descriptions of waters, regulations, or conditions — is complete, accurate, or up to date, and we may change the Site at any time without notice. Fishing regulations change; always verify current rules with the North Carolina Wildlife Resources Commission.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Team Barefoot, Inc., its owners, guides, and contractors will not be liable for indirect, incidental, special, or consequential damages arising out of your use of the Site or participation in the Services, and our total liability in connection with the Services will not exceed the amount you paid to us for the trip or service giving rise to the claim. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability arising from gross negligence or willful misconduct.

10. Indemnification

You agree to indemnify and hold harmless Team Barefoot, Inc., its owners, guides, and contractors from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your violation of applicable law or regulations, or your misuse of the Site.

11. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Services will be brought exclusively in the state or federal courts located in North Carolina, and the parties consent to the jurisdiction of those courts. Before filing any legal action, the parties agree to first attempt in good faith to resolve the dispute through direct discussion or mediation.

12. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date above reflects the most recent version. Continued use of the Site or booking of Services after changes are posted constitutes acceptance of the updated Terms.
